Description

In an effort to formulate a state-wide dialogue about the environment, NCEDA recently developed a public web space known as the "Enviroblog. "

The Enviroblog is a group web log dedicated to discussing issues surrounding the environment.

The NCEDA Enviroblog is divided into various sub-blogs based on environmental issues particularly applicable to the state of North Carolina. The sub-blogs are as follows:

1. Air Quality
2. Water Quality
3. Coastal Management
4. Environmental Health
5. Soil Conservation
6. Forestry
7. Wildlife & Endangered Species
8. Wetland Protection

All sub-blogs are accessible through the general Enviroblog site.

In order to participate in the Enviroblog community, users must agree to and abide by the following terms and conditions of use. The terms and conditions of use apply both to the general Enviroblog as well as its sub-blogs.


Terms and Conditions of Use:

 

General Posting Rules

Users may post content freely to the Enviroblog so long as the content is not illegal, obscene, defamatory, threatening, abusive, harassing, knowingly false or inaccurate, infringing of intellectual property rights, invasive of privacy, a blatant expression of bigotry, racism, or hate, or otherwise injurious or objectionable. Users posting to the Enviroblog may link to outside websites so long as the links abide by these terms and conditions.

Furthermore, as an Enviroblog participant, users understand that all messages appearing here are the sole responsibility of those persons posting the message. This means that a user, and not NCEDA, is entirely responsible for all information and material that a user posts on the Enviroblog. NCEDA does not and cannot control the content of any messages posted on the Enviroblog and does not and cannot guarantee the accuracy, integrity, propriety or quality of any information posted by non-agency personnel. Any reliance upon content posted in the Enviroblog forum is at the user's own risk.

 

Right to Remove

As part of the North Carolina state government, NCEDA reserves the right to remove content, with or without notification to users, that is abusive, illegal, disruptive or that otherwise fails to conform to the terms and conditions of use.

NCEDA also reserves the right (but is not obligated) to edit or delete any communications posted on the Enviroblog, regardless of whether such communications violate these standards for content.

 

Right to Re-Produce Postings

By submitting and/or posting content on the Enviroblog, users automatically grant to NCEDA a royalty-free, perpetual, irrevocable, non-exclusive and fully sublicensable right and license to use, reproduce, modify, adapt, publish, edit, translate, distribute, perform, create derivative work of and display such content alone, or as a part of other works in any form, media, or technology, whether now known or hereafter developed. Any and all content users transmit or post may be used by NCEDA or licensed to others by NCEDA for any purpose, including but not limited to reproduction, disclosure, transmission, publication, broadcast, and posting.

 

No Advertising

The Enviroblog is only for users' personal and noncommercial use. It is meant to facilitate discussion and debate. Therefore, users may not use the Enviroblog to post or transmit advertisements or commercial solicitations of any kind. This includes, but is not limited to unsolicited e-mail that includes advertising or chain letters.

 

Copyright

Users are not permitted to post any copyrighted material nor violate NCEDA's copyright or service mark policies. Users may not post or transmit any material of any nature, including text, audio, software, animation or photographs, belonging to any person or party other than themselves, without the prior written consent of such owner. Simply because material is available on the Internet does not mean it is in the public domain. The vast majority of materials on the Internet are protected by copyright and trademark laws. You must comply with the terms of the Digital Millennium Copyright Act.

 

Indemnity

As a user, you agree to defend, indemnify, and hold harmless NCEDA, its officers, directors, affiliates, employees, agents, licensors, and suppliers, from and against any and all claims, actions, or demands, liabilities and settlements, including without limitation, reasonable legal and accounting fees, arising from use on this Enviroblog, or use by others with respect to you, including, without limitation, any claim of libel, defamation, harassment, violation of rights of privacy or publicity, loss of service or infringement of intellectual property rights, or breach of these terms and conditions of use.

 

Termination of Privileges

NCEDA reserves the right to terminate a user's privilege to use all or any portion of the Enviroblog if a user breaches any of the terms and conditions of use. If NCEDA receives notice or otherwise discovers that a user has posted material that infringes another party's copyright or trademark rights, or violates another party's rights of privacy or publicity, NCEDA may terminate that user's access to the Enviroblog, including all the privileges or accounts that user may have established in connection with the Enviroblog.

 

Acceptance of Terms and Conditions of Use

Through use of the Enviroblog forum, users are agreeing to all of the aforementioned terms and conditions of use contained herein.
