After reading the information about search engines and trademark infringement ponder the following the questions. 

  • Are search engine providers simply a scapegoat for trademark infringement claims?  Who deserves the blame?

  • Considering that the policy behind trademark law is to prevent consumer confusion, who do you think causes confusion when a trademarked term is used in a meta tag, the web site owner or the search engine?

  • To what extent should a search engine provider be required to ensure that terms purchased in it keyword advertising program are not trademarked terms?

  • Does the use of trademarked term in a meta tag really confuse consumers?

  • How is a trademark owner harmed by the use of its trademark in website owner meta tag?
