Meta Tags Keywords Click Fraud Portals Dilution Defenses Policy Issues

Portals are websites designed to be used as consumer’s Internet home page.  The purpose of a portal is to allow consumers to use search engines or directories directly from their home page. Portal Registration is the process by which businesses register their websites through internet portals or directories.  During the registration process, businesses are able to select keywords which consumers may use to search the directory.  The legal concern is whether using a competitor’s trademark or trade name as a portal keyword infringes on that competitor’s trademark.  Unfortunately, this issue has not been resolved by the court or congress at this time.  However, considering that there are technical similarities between portal and meta tags, trademark cases involving meta tags might be a resource.
