Fake Identification

"Just because you're in costume doesn't mean they can't catch you and prosecute you."

--David Crescenzo , Attorney for CSLS Inc., on students who try to use fake IDs while celebrating Halloween.                                                       DTH  October 29, 2004

What is the Law?
It is unlawful to display or possess a fictitious, canceled, revoked, suspended or altered driver's license. It is unlawful to counterfeit, sell, lend, or knowingly permit the use of a driver's license by one not entitled. You cannot use another's valid license. The violations are all misdemeanors punishable by a fine up to Five Hundred Dollars ($500.00) or up to six (6) months in jail. Also, using a fictitious driver's license to purchase alcohol, or allowing your otherwise valid license to be used fraudulently to purchase alcohol, is a misdemeanor. Upon conviction, the Department of Motor Vehicles must suspend the offender's driver's license for one year.

Other Offenses
Some fake driver's license offenses are very serious and carry considerable penalty. You cannot lie or commit a fraud in an application for a license, or knowingly permit someone else to do so. (For example, present someone else's birth certificate as your own, and swear to it.) If you knowingly swear or affirm falsely in an application where oath is required, that is perjury, a felony punishable by up to ten years in prison. It is a felony to sell any reproduction or facsimile or simulation of a driver's license or learner's permit.

Purchasing Alcohol
With specific reference to the use and purchase of alcohol, if you are underage you cannot obtain or try to obtain alcoholic beverages with a fraudulent or altered license or identification document, or someone else's license or I.D. This is a misdemeanor and also carries with it the suspension of your driver's license. If you allow someone to use your license (or other identification document) to make or try to make an underage purchase, that is a misdemeanor and will also result in the suspension of your license. If you are underage and you aid or abet (i.e. help) another in buying or possessing (or trying to buy or possess) alcohol, that is a misdemeanor and will also take your driver's license.
