Penalties and Sanctions

The use of Internet and e-mail services at NCEDA is a privilege, not a right. Inappropriate use, including any violation of these conditions, rules, and policies,
may result in the use of disciplinary action. Disciplinary action administered may include warning, suspension of Internet privileges, criminal sanctions, or demotion, up to and including dismissal.

The form of disciplinary action administered is to be determined by the NCEDA disciplinary action committee. NCEDA employees maintain rights of appeal to any suspension, demotion, or dismissal resulting from violation of the above conditions, rules, and policies.

Copyright and Trademark

The NCEDA website, and all of its contents, including but not limited to publications, photographs, images, illustrations, and other resources (collectively "Intellectual Property") are protected by copyright, service mark, and other laws of the United States.

All materials of this website, not specifically identified as property of another party, are the copyrighted property of NCEDA, all rights reserved. Web pages that these pages link to are in turn copyrighted by their individual authors who reserve all their rights.

Employees using NCEDA's Internet and e-mail services may not transmit copyrighted material belonging to entities other than NCEDA. All employees obtaining access to another entity's or individual's materials must respect all copyrights and may not modify or forward copyrighted materials, except with permission or as a single copy to reference only. Failure to observe any copyright or license agreements may result in disciplinary action.

However, NCEDA employees may reproduce or copy materials for the purpose of fair use, as delineated in the United States Copyright Act. These purposes include, but are not limited to criticism, comment, news reporting, teaching, scholarship, or research. Any questions or concerns involving the fair use of another entity's or individual's copyright should be directed the appropriate NCEDA department manager.

The NCEDA logo is an official registered service mark and not available for general use. Employee use of the NCEDA logo is reserved for official business, including but not limited to official publications, electronic or paper. NCEDA employees may not use the NCEDA logo for any business not relating to the NCEDA and its general powers and services. NCEDA employees must respect all trademarks and service marks and may not modify or forward any other trademark or service mark materials.

Retention of Ownership

In general, both law and NCEDA policy prohibit theft or other abuse of computing resources. All software programs belonging or licensed to NCEDA or the state of North Carolina, as well as documentation generated or provided by employees, consultants, or contractors for the benefit of NCEDA, are the property of the state of North Carolina unless otherwise provided in an express written agreement.

Security

The NCEDA computer system, including parts of the website pertaining only to NCEDA employees, is password protected. All employee passwords must be made known to NCEDA. The use of passwords to gain access to the computer system, specific files, or this website does not provide users with an expectation of privacy in the respective system or document. Passwords should not be given to other people and should be changed every ninety (90) days.
