Refusal of Registration

 

If the domain name fails this test, the applicant seeking registration must be refused on the ground that the matter presented for registration does not function as a mark. 

The statutory bases for the refusals are:

1.    For trademarks: Trademark Act §§1, 2 and 45, 15 U.S.C. §§1051, 1052, and 1127

2.    For service marks: Trademark Act §§1, 2, 3 and 45, 15 U.S.C. §§1051, 1052, 1053 and 1127
